(3) Supply of Dustbins
The London County Council (General Powers) Act, 1954, came Into
operation during the year and Section 12 of this Act removed the
doubt as to whether notices requiring the provision of dustbins
were to be served either on the owner or the occupier of a house
and provided that in all cases they were to be served on the owner.
The owner having right of appeal to a court of summary Jurisdiction
on the ground that the obligation ought to fall upon the occupier of
the house.
In the majority of cases an informal letter to the owner has
been sufficient to obtain the provision of a new dustbin and this
has probably been assisted by the fact that the Borough Council has
been able to supply a standard bin for £1, which is somewhat less
than the price charged by private traders.
In 26 cases during the year notices were served upon the owner
in accordance with Section 12 of the London County Council (General
Powers) Act, 1954, 15 notices being served under Section 105 of the
Public Health (London) Act, 1936, prior to the coming into operation
of the London County Council (General Powers) Act, 1954. In no
Instance was an appeal lodged.
(4) Legal Proceedings
It was found necessary on 50 occasions during the year to take
legal proceedings to enforce compliance with the requirements of
Notices served.
In 9 of these cases Abatement Orders were made by the Justices
with the infliction of costs amounting to £23.12s.6d. Brief
details are set out below.
