LEGAL PROCEEDINGS UNDER THE PUBLIC
HEALTH (LONDON) ACT.
Under this Act, 3888 Intimations and 2383 Notices were served.
These were followed in 678 cases by a third or Final Notice.
Including 28 summonses taken out, but not heard, in 1899 the
number of summonses dealt with was 159. Of these, 39 were
withdrawn, the nuisances complained of having been abated.
Twenty-eight magistrate's orders to abate nuisances were made,
and 2 orders to close premises. In 56 cases where works had been
done orders were obtained for the Vestry's costs. Fourteen cases
were not disposed of at the end of the year, and the remaining
cases do not call for any special comment, except those which will
be dealt with under separate heads.
SMOKE NUISANCES.
The action of your Committee, previously commenced, has been
continued throughout the year, and the clauses of the Act relating
to smoke nuisances has been steadily and regularly enforced, with
the result that there has been a great improvement in this direction.
No one has been summoned without full notice, and after
every opportunity for improvement has been given. Sixty-eight
Intimations and 39 Notices were issued; 13 summonses were
taken out, and of these 1 was unconditionally withdrawn in consequence
of a technical error in description; 1 was withdrawn on
payment of £3 3s. costs, the proprietor of the factory having
made alterations to his boiler and shaft, and one in consequence of
a change having taken place in the occupation of the premises.
In the last case the Vestry's costs were also paid. In two cases
the magistrates made an order to prevent a recurrence of the
nuisance, with £3 3s. costs in each case, and in the remainder fines
ranging from £1 to £10 were imposed. In connexion with this
I wish to record my appreciation of the assistance rendered by
Mr. Spencer, of the Public Control Department of the London
County Council, and Dr. King Warry, Medical Officer of Health
of the Hackney Vestry, who each directed one of their officers to
attend at Worship Street and give evidence on our behalf, and
which evidence greatly strengthened our case, with the result that
a fine of £10 was imposed.
UNSOUND FOOD AND MARKET INSPECTION.
The following cases occurred in respect of unsound food exposed
for sale: J.S., 11, St. John Street, exposing rotten cherries in
Brick Lane, fined £10, about one barrow-load of cherries seized
