the Local Authority for this purpose, certifies that the
provision of food or milk is necessary, food or milk may
be supplied free or may be sold at less than cost price."
The requisite powers and duties for the discharge of the functions
assigned by this Order were conferred by the Local Government Board
upon the Borough Council by their Order, The Local Authorities (Food
Control) Order (No. 1), 1918, dated 8th February, 1918, and in a
covering letter, dated 9th February, 1918, the Board drew the attention
of the Council to these Orders.
These Orders remained in force until 22nd December, when they
were superceded by the Milk (Mothers and Children) Order, 1919, and
The Local Authorities Milk (Mothers and Children) Order, 1919.
These two latter Orders re-enacted those Orders with the following
modifications:—
(a) The Order related to milk only and not to food.
(b) The power of the Local Government Board to require local
authorities to make arrangements for the supply of milk was
omitted.
(e) Local authorities were empowered to supply milk free or at less
than cost price not merely in necessitous cases but also where
such a supply is necessary because of the retail price of milk
in any area.
Tho quantity of milk to be supplied was specified to be the same as
that stated in the Local Government Board Circular of 9 th February, 1918.
The effect of the Order therefore was to empower local authorities
to supply milk to expectant and nursing mothers and young children
without previously obtaining the consent of the Ministry of Health (as
required by the Maternity and Child Welfare Act, 1918, in respect of
distribution carried out under that Act) free or under cost price where
some person authorised by the local authority certified this to be
necessary by reason of the retail price of milk in its district.
It should be understood that the Maternity and Child Welfare
grant distributed by the Ministry of Health is limited to the cost of
any food, including milk, distributed to necessitous cases occurring
among expectant and nursing mothers, and children under five years of
age, who are certified by the Medical Officer of the Centre, or by the
Medical Officer of Health, to be in need of the food or milk. It does
not apply to any other class of the community.
