requested to bring the matter to the notice of the

Special
Memorandum.
SALE OF FOOD AND DRUGS ACTS, 1875—1907.
Milk Warranty Defence.
The question of "milk warranty defence" has again been
under the consideration of the Public Health Committee of this
Council, and at their meeting on the 22nd instant, on the report
of certain Police Court proceedings the Town Clerk was
requested to write to: —
(a) The President of the Board of Agriculture and
eries, and
(b) The President of the Local Government Board,
and to request their earnest attention to the matter.
With- a view to securing some early amendment of the law
as it now stands, the Public Health Committee desire to point
out that in common with other Sanitary Authorities who have
already directed attention to this matter, it is becoming increasingly
difficult to take any proceedings likely to have a
successful issue, especially in respect to milk samples found
upon analysis to be deficient in butter fat or cream.
In practice it is now quite common on any milk retailer
being prosecuted for any offence relating to the sale of milk, for
such retailer to give notice to the prosecution that he intends to
rely upon a warranty granted by the wholesale contractors.
At the hearing of the information such warranty is duly proved
and the complaint dismissed.
If proceedings be taken against the wholesale contractor,
precisely similar procedure is repeated by this contractor,
giving notice of a warranty from some other person.
