On the 2nd December an interview took place between Price's
legal representative, the Chairman of the Health Committee, the
Town Clerk and the Medical Officer of Health, and at the interview
it was stated that Messrs. Price were taking action on their
own account against the London County Council. When their
private action was heard, the Borough Council's Medical Officer
was subpoenaed by Messrs. Price's Solicitors to give evidence.
The case was heard before Mr. Justice Neville in the High
Court of Chancery on 30th April, 1908, and subsequent days, and
judgment was given in favour of Messrs. Price, the Court holding
that a nuisance of a serious and even dangerous character
resulted from the discharge of the storm poluted waters into the
Creek; that the powers possessed by the London County Council
with regard to the sewerage of London under the Metropolis
Management Acts did not entitle the Council to cause a nuisance.
This judgment was appealed against by the London County
Council, but the Court of Appeal upheld the judgment of Mr. Justice
Neville. Further legal action by the Borough Council was
consequently unnecessary.
